On Aug. 1, 2018, the Minnesota Pollution Control Agency (MPCA) issued the 2018 Construction Stormwater Permit for any construction activity disturbing more than one acre or land.
Under the 2018 Permit, ongoing projects started under the 2013 Permit are required to either complete work and terminate the permit or update the project’s stormwater pollution prevention plan (SWPPP).
SWPPPs must be updated by Saturday, Feb. 1, 2020, to reflect the requirements of the new permit.
Once the project is complete, a notice of termination must be submitted using the form on the MPCA’s website. The termination form can be found here.
Permit holders are not required to make any changes to the permanent stormwater treatment system. They are only responsible for complying with the new erosion and sediment control practices of the 2018 Permit. A summary of all permit changes can be found here.
In 2017 and 2018, Housing First Minnesota staff and erosion control experts from the Regulatory Affairs Committee worked on recommendations for a Construction Stormwater Permit that had no cost changes, other than Federal mandates, and provided environmental protections.
